LATITUDE VEHICLE RENTAL

General Terms and Conditions

1. RENTAL AND DURATION

The motor vehicle is hereby leased by LATITUDE Expeditions to the Client at the agreed upon rate and period specified in the Rental Agreement.

The amount paid is non-refundable and non-transferable.

2. DELIVERY AND RETURN

The vehicle shall be returned to Husaak Adventure Center unless delivery has been agreed between the parties. 

The vehicle will be delivered to the Renter in good overall condition and without apparent defects, except those that have been disclosed to the Renter prior to or on delivery. Any complaints as to the condition of the vehicle are to be made to LATITUDE immediately upon receiving the vehicle.

The Renter agrees to return the vehicle with a full petrol tank. The Renter will incur a 5 OMR charge and the cost of filling the tank if this is not done on return. Documents, set of keys and any accessories must also be returned with the vehicle.

LATITUDE reserves the right to repossess the vehicle at any time without prior notice and at the Renter’s expense if the vehicle is used in violation of this agreement.

3. DAMAGE, LOSS, THEFT, etc.

In the event of damages to or loss or theft of the vehicle or its parts, including fire and breakage of glass, the Renter shall, irrespective of the Renter’s or drivers fault, pay LATITUDE the amount of all resulting loss and expenses of LATITUDE (including but not limited to replacement or recovery costs, repair costs, compensation for decline in value and loss of rental revenue).

Smoking is strictly prohibited in all LATITUDE vehicles. In the case where this is violated, the Renter will incur a 50 OMR additional cleaning fee.

The Renter’s liability shall not extend to ordinary and foreseeable consequences resulting from the intended use of the vehicles, such as:

  • The requirement for normal service, repair, fair wear and tear of the vehicle given its intended use/s;
  • The replacement of tires in the event of punctured or damaged tires;
  • Mud / dust / sand / reasonable dirtiness on car exterior;
  • Acceptable dirtiness within the interiors of the vehicle.

4. INSURANCE

If agreed on by the parties in the Rental Agreement, and where paid for by the Client, the rented vehicle may be covered by third party liability insurance depending on the type of Collision Damage Waiver (CDW) chosen. The insurance package will limit the Client’s liability to a maximum of 250 OMR, unless, no Collision Damage Wavier is accepted or selected by the client. 

Insurance coverage is subject to compliance with all terms of use listed in this agreement and the Rental Agreement, particularly the Conditions of Use listed in Clause 7.

Importantly, the insurance does not cover the Modification Kit, which is comprised of the following:

  • Front Steel Bar;
  • Rear Steel Bar;
  • Rear spare wheal carrier;
  • Rear Jerrycan carrier;
  • Side Shade Awning;
  • Roof Rack;
  • Snorkel; and
  • Suspension Kit.

In the case of any damage to the Modification Kit, the Client will be fully liable for costs of repair or replacement no matter what type of Collision Damage Waiver is selected.

5. RENTAL CHARGES

The Renter agrees to pay rental charges according to current prices of LATITUDE that are valid at the time this agreement is signed. By signing the Rental Agreement the Renter agrees to pay rental charges and other additional charges stipulated in this agreement, according to the payment method agreed.

6. LIABILITY OF LESSOR

LATITUDE is liable only for loss or damage caused to the Renter or a third party connected with rental or usage of rented vehicle if such loss or damage was caused by the LATITUDE’s fault or deliberate gross negligence. 

7. CONDITIONS OF USE

All European, United Kingdom (card licenses), American, Canadian, Australian, New Zealand, GCC Countries and South African licenses in ENGLISH are accepted in Oman. We always recommend carrying a valid international license, which is mandatory for other countries. National licenses must be provided with international licenses.

The Renter or Additional Driver must be 25 or older.

The Renter is expected to look after the vehicle as a decent and careful owner. The vehicle is to be used for reasonable and foreseeable uses contemplated in the LATITUDE itinerary or in connection with its intended purpose in adventure tourism. 

The Renter must make sure the vehicle is not used as follows:

  1. In a reckless or unreasonable manner;
  2. For extreme or risky activities that have not been disclosed or agreed upon with LATITUDE;
  3. In any race, test or contest or training/preparing for such events;
  4. In any territory outside of the Sultanate of Oman, unless the United Arab Emirates has also been mutually agreed on between the parties an additional location as per the Rental Agreement;
  5. For driving in any water bodies.
  6. Striking overhead or overhanging objects;
  7. Driving into a barrier that is too low for the vehicle to pass beneath;
  8. Driving into a barrier in a car park before it fully opens;
  9. Driving on a road in bad condition without due care resulting in damage to the undercarriage;
  10. Driving on a beach causing damage by salt water;
  11. Driving through flooded roads causing damage to the engine;
  12. Putting wrong fuel in the vehicle or otherwise contaminating the fuel;
  13. Damage occurring as a result of ignoring a warning light;
  14. Damage to the wheel rim caused by driving with a flat tyre;
  15. Fitting unauthorized objects to the interior or exterior of the vehicle;
  16. Carrying especially dirty or smelly materials that require extra cleaning costs or that damage or burn the interior;
  17. Damage resulting from locking the keys in the vehicle or losing the keys;
  18. Damage resulting from leaving the windows open.

When leaving the rented vehicle, the Renter is fully responsible for locking the doors and closing the windows, as well as not leaving in the vehicle its registration documents and keys.

The Renter/driver of the rented vehicle must comply with the relevant Omani regulations regarding driving under the influence of alcohol and other intoxicating substances, compliance with traffic regulations and other legal regulations.

It is forbidden to hand over the rented vehicle to a third person unless this person is registered as an additional driver in this agreement.

8. PENALTIES

In case of lost car keys the Renter will be charged a fee of 150 OMR.

A smoking fee of 50 OMR will be charged in case of violation.

A fee of 5 OMR in addition to the cost of filling the tank will be charged if the vehicle is not returned with a full tank.

Any damages to the Modification Kit will be incurred by the Renter.

All tickets and administrative sanctions resulting from the violation of traffic laws and regulations during the rental period are absorbed solely by the Renter. Additional administrative handling fee for the same amount may be charged.

9. ACCIDENTS AND THEFT

The Renter agrees to act in accordance with respective Omani traffic regulations, including calling and notifying the police (9999) if the Renter is involved in a traffic accident. If the vehicle is stolen, this must be reported to the police to ensure that the theft is registered.

In the case of any accidents of theft of the vehicle or its parts the Renter must inform LATITUDE immediately and may be required to fill in a damage or theft report. The Renter must ensure that all information is collected from other parties involved in the accident, and contact information of eye witnesses is collected in order to have complete information of the incident. The Renter is obliged to assist LATITUDE and/or its insurance companies in all claims or legal affairs in connection with the accident, damage or theft of the vehicle or its parts.
